Boarding Agreement

The Proprietor of Best Buddies Boarding Kennels (Proprietor) accepts the Owner’s dog (or dogs) for boarding strictly on the terms and conditions set out below:

General Admission Policy: The Owner warrants that any known health or behavioural issues concerning the dog have been fully disclosed to the Proprietor prior to commencement of boarding and that, except as so disclosed, the dog is sound and healthy.  The Proprietor reserves the right not to accept the dog for boarding if it appears to have an illness or injury or demonstrates aggression, or for any other reason in the Proprietor’s absolute discretion. If during boarding the dog demonstrates aggressive behavior such that the Proprietor is reasonably of the view that the dog represents a threat to the Proprietor’s staff or other dogs, the Proprietor will require the Owner to remove the dog from the premises immediately and will contact the Owner and/or nominated emergency contact to arrange this. The Proprietor reserves the right to report to the authorities any dog that the Proprietor reasonably considers satisfies the requirements for being declared a dangerous dog within the meaning of the Dog Act 1976 (WA).

Pick Up and Collection: Unless otherwise agreed, all dogs must be dropped off and collected during standard kennel opening hours (as advised by the Proprietor) on the dates set out in the booking form.  The boarding fee is calculated on a per day basis, regardless of the time of arrival or departure.  If the dog is not collected (or cannot be released pursuant to this Agreement) on the advised date of departure then, unless adequate notice has been given and the Proprietor agrees, boarding fees equivalent to double the standard daily rate will be charged for each day the dog remains on the premises.

Payment: Payment of the boarding fee for the entire duration of the dog’s stay and any charges for additional services requested by the Owner are due in advance at the commencement of boarding. Unless otherwise agreed, boarding fees are non-refundable, even if the dog is collected prior to the anticipated departure date.  Any additional expenses incurred by the Proprietor in accordance with this Agreement and any fees for stays beyond the advised departure date must be paid by the Owner on collection of the dog.  The Proprietor is entitled to retain possession of the dog (and ongoing boarding fees will apply) until all amounts owed by the Owner have been paid in full. Inability to pay will still be treated as abandonment and all payment must be received within 7 days from agreed date of collection.

Vaccinations and Parasite Control: A dog will not be accepted for boarding unless the Owner provides proof that the dog is fully vaccinated.   If the dog is found to have fleas or worms during boarding it will be given an appropriate treatment by the Proprietor at the Owner’s expense.

Veterinary Treatment: Should the dog require, in the Proprietor’s opinion, veterinary treatment while boarding, such treatment will be at the Owner’s expense.   All veterinary costs incurred by the Proprietor and the Proprietor’s reasonable costs of transport to the treating veterinarian must be paid in full on collection of the dog. If the dog dies while in boarding all costs for storage and removal of the body will be paid for by the owner along with all boarding fees. Post mortems are at the owner’s expense. If the owner requires to put a value on veterinary treatment the amount must be mentioned on the boarding agreement.

All instructions regarding Medication for the dog MUST be given in writing. If the dog refuses to take medication or shows aggression while trying to administer medication then the dog must be removed from boarding.

Responsibility: The Proprietor will take all reasonable care for the dog while boarding.  However, except in the case or gross or willful negligence, the Proprietor shall not be liable in any way, and the Owner hereby releases and indemnifies the Proprietor from and against any such liability, for any illness, injury or death of the dog, howsoever caused, or for any cost or expense incurred by the Owner as the result of such illness, injury or death. If the dog tries to jump or climb out of the pens then the dog must be removed from boarding as it could injure itself or other boarders. We do not accept dogs that are not able to be in proximity to other dogs without them becoming stressed or aggressive. Dogs that go more than three days without eating will be asked to be collected for the wellbeing of the dog. The owner’s Alternative contact must be in agreement to take responsibility for the dog/s if there is any breach of this contract.

Warranty and Indemnity: The Owner warrants that all information provided to the Proprietor in relation to the dog is true and correct.  The Owner indemnifies the Proprietor against any loss, damage, claim, expense, cost (including legal costs) or liability that the Proprietor suffers or incurs as a result of (a) any information provided by the Owner to the Proprietor being incorrect or untrue, (b) any breach of this Agreement by the Owner, and (c) the personal injury or death of any person, or damage to or destruction of any property, caused or contributed to by the Owner’s dog.

Default: The Owner grants to the Proprietor the dog as security for payment of any amounts owing under this Agreement. If the Owner defaults in payment of any amounts due under this Agreement, the Proprietor shall, be entitled to retain possession of the dog. If the default continues for a period of 7 days the proprietor has the right to sell or dispose of the dog and place the matter with debt collection agents. The signed boarding agreement is binding and 7 days after the collection date for the dog has lapsed the dog will be deemed abandoned and there will be no repercussions to the proprietor for removing abandoned dog/s from the premises.

Ownership: The Owner warrants that he/she is the legal owner of the dog and is entitled to sign the Agreement for and on behalf of any co-owners. The dog will not be handed over to anyone other than the person signing the dog in, unless arranged in writing. Any person claiming to have rights over a dog in boarding and is not known to the proprietor  will be asked to leave the premises and the police called.

 

The Owner hereby accepts the above conditions of boarding and will sign the booking form as a binding agreement to all the conditions mentioned here without exception.
